Title 10, Chapter 1, Section 436
( 10-1-436)
(a) Whenever the Attorney General or any district attorney has
reason to believe that any person is violating any provision of this
part, he may bring an action against such person to restrain or
enjoin continued violations. With the exception of consent
judgments entered before any testimony is taken, a final judgment
under this Code section is admissible as prima-facie evidence of
such specific findings of fact as may be made by the court which
enters the judgment in subsequent proceedings by or against the same
person or his successors or assigns. (b) Any person who violates any provision of this part may be liable
for a civil penalty not to exceed $500.00 for each violation. Such
penalty may be assessed and recovered in a civil action brought by
the Attorney General or any district attorney. |
