Title 18, Chapter 4, Section 5
( 18-4-5)
(a) Any party of record to a proceeding under this chapter who may
be affected materially thereby may challenge the sufficiency of any
bond required or permitted by this chapter. Such challenge shall be
made by motion to require additional security; and, if upon hearing
the same the court shall determine that the security upon the bond
is inadequate for the purposes for which the bond is filed, an order
shall be entered requiring the person filing the bond to furnish
additional security within seven days of the date of the order. (b) The original surety shall not be discharged from his liability
on the bond until another surety is approved. |
