Title 20, Chapter 3, Section 263
( 20-3-263)
(a) There is created a public authority, a body corporate and
politic, to be known as the Georgia Higher Education Assistance
Corporation, which shall be deemed to be an instrumentality and a
nonprofit public corporation of the state. (b) The corporation created by subsection (a) of this Code section
shall be the successor to and a continuation of, without
interruption, the previously existing Georgia Higher Education
Assistance Corporation created by an Act approved March 12, 1965
(Ga. L. 1965, p. 217), as amended. The continuation of the Georgia
Higher Education Assistance Corporation, as provided in this Code
section, shall in no way affect any existing obligations,
liabilities, or rights of the previously existing Georgia Higher
Education Assistance Corporation. All such obligations,
liabilities, and rights, including, without limitation, obligations,
liabilities, and rights in respect of loan guaranties issued to
lenders by the previously existing corporation and in respect of
payment of state interest subsidies and placement, conversion, and
loan discount fees on loans guaranteed by the previously existing
corporation, pursuant to provisions of state and federal laws in
effect at the time such obligations, liabilities, and rights were
incurred or created are transferred to, vested in, and assumed by
the corporation created by subsection (a) of this Code section. All
contracts and agreements between any party and the previously
existing Georgia Higher Education Assistance Corporation shall not
be affected by this Code section but shall continue in full force
and effect, without interruption, as contracts or agreements between
such party and the corporation created by subsection (a) of this
Code section. (c) Right, title, interests in, and ownership of all assets of the
previously existing Georgia Higher Education Assistance Corporation
are transferred to and vested in the corporation created by
subsection (a) of this Code section. (d) The corporation created by subsection (a) of this Code section
is designated as the state guaranty agency to administer the program
in this state as provided for in the federal act and this part. |
