Title 29, Chapter 4, Section 11 (29-4-11)

If there is no application for letters of guardianship and a necessity for a guardian exists, the judge of the probate court, after giving notice for 30 days, may vest the guardianship in the county guardian, the clerk of the superior court of the county, or any person or persons residing in the county whom he, in his discretion, deems fit and proper and require bond and security as in other cases.
