All licenses issued to facilities prior to July 1, 1985, shall expire December 31, 1985. Upon the expiration of any license issued prior to July 1, 1985, the personal care home to which such license was issued shall be required to obtain a separate license for each of the personal care home's existing facilities and shall have a separate director for each such facility. An existing facility whose license so expires may only be issued a temporary license until that facility qualifies for a regular license, unless that facility submits evidence, satisfactory to the department, that within the immediately preceding 12 months the director received a satisfactory fingerprint records check determination and each employee received a satisfactory preliminary records check determination, in which event that facility may be issued a regular license without first having to obtain a temporary license. A temporary or regular license may only be issued if the facility otherwise qualifies for a license pursuant to Article 1 of this chapter. Any new facility in this state first owned or operated on or after July 1, 1985, by a personal care home already licensed in this state shall be required to have a new license issued pursuant to Code Sections 31-7-251 through 31-7-255. |
