Title 34, Chapter 8, Section 93
( 34-8-93)
(a) Any ambiguity in this chapter shall be construed in a manner
consistent with federal law applicable to the unemployment
compensation program. (b) In the event any Code section, subsection, paragraph,
subparagraph, sentence, clause, phrase, or provision of this chapter
shall be ruled unconstitutional by any court or out of conformity
with federal law by the United States secretary of labor, such
provision shall be null and void and of no force and effect. The
General Assembly declares that it would have passed the remaining
portions of this chapter if it had known that any such part or
provision of this chapter would be declared unconstitutional or out
of conformity with federal law by the United States secretary of
labor. Further, the Commissioner shall have the authority to make
procedurally the necessary adjustments in order to bring about
conformity with federal law, pending action of the General Assembly. |
