( 38-2-27)
(a) The Governor shall conform the organization of the Georgia
National Guard and the Georgia Naval Militia, including the
composition of all units thereof, to the organization of National
Guard and Naval Militia units prescribed by the laws of the United
States and the regulations issued thereunder. (b) For the purposes stated in subsection (a) of this Code section,
the Governor is authorized: (1) To organize, reorganize, or disband any unit, headquarters, or
staff therein; (2) To increase or decrease the number of commissioned officers,
commissioned warrant officers, warrant officers, petty officers,
and noncommissioned officers of any grade therein; and (3) To increase or decrease the strength of the Georgia National
Guard and the Georgia Naval Militia. (c) Notwithstanding the provisions of subsection (b) of this Code
section, no organization of the Georgia National Guard, the members
of which shall be entitled to and shall have received compensation
under 32 U.S.C. Section 104(f), as amended, shall be disbanded
without the consent of the President of the United States; nor,
without such consent, shall the commissioned or enlisted strength of
any organization in the Georgia National Guard be reduced below the
minimum prescribed therefor by the President of the United States. |
