(a) Any person who knowingly and willfully violates this article or the rules and regulations promulgated under this article shall be guilty of a misdemeanor.

(b) Any person convicted of a misdemeanor under this article shall in addition to any punishment prescribed therefor be ineligible for appointment to or employment in a position in the state service for a period of five years after such conviction.
