( 50-16-81)
(a) The state or any department, agency, political subdivision, or
municipality of the state may enter into and make any contract with
the United States or with any department or agency thereof for the
purchase, lease, or other acquisition of any equipment, supplies,
material, or other property, both real and personal; and any
political subdivision or municipality of the state may contract with
the state or any department or agency thereof for the purchase,
lease, or other acquisition of any such equipment, supplies,
materials, or other property, both real and personal. Either of
such contracts may be made without: (1) Publicly advertising for bids or posting notices of
expenditures; (2) Inviting or receiving competitive bids; or (3) Requiring delivery of purchases before payment. (b) The appropriate authority of the state, department, agency,
political subdivision, or municipality may designate an employee or
officeholder to enter bids at sales of equipment, supplies,
material, or other property, both real and personal, owned by the
United States or an agency thereof. The person may be authorized to
make any payments required in connection with the bidding and sale. (c) This Code section shall apply only to contracts made with the
United States or with any department or agency thereof by the state
or any department, agency, political subdivision, or municipality of
the state or to any contracts made with the state by any political
subdivision or municipality thereof. (d) This Code section shall not be construed to repeal, alter,
amend, change, or modify in any manner whatsoever any general,
local, or special law as to the method of procedure or requirements
provided for the making of any contract by any of the stated
authorities other than the kind of contracts set forth in this Code
section. |
