Title 53, Chapter 12, Section 26 (53-12-26) Except as otherwise provided by law, a trust shall be executory and the legal estate shall remain in the trustee only so long as the trustee has any powers or duties in regard to the trust property and the trust serves a material purpose of the settlor.
