(a) Every manufacturer who manufactures manufactured homes outside
the State of Georgia and who sells or offers for sale a manufactured
home in Georgia shall apply for and obtain a license. (b) Every manufacturer who manufactures manufactured homes in
Georgia shall apply for and obtain a license. (c) Every dealer who sells or offers for sale new or used
manufactured homes or mobile homes in Georgia shall apply for and
obtain a license. (d) Applications for licenses and renewal licenses shall be obtained
from the Commissioner and submitted to him on or before January 1 of
each year. All applicants shall certify in the application that all
construction, electrical, heating, and plumbing standards will be
complied with as set forth in this part and in the rules and
regulations of the Commissioner. (e) The license and renewal license fee shall be $200.00 per
manufacturing plant which manufactures manufactured homes within the
State of Georgia; $200.00 per out-of-state manufacturing plant which
manufactures manufactured homes for the purpose of offering for
sale, or having such homes sold, within the State of Georgia; and
$100.00 per dealer location which sells, offers for sale, or
transports to sell such homes within the State of Georgia. The
license shall be valid from January 1 through December 31 of the
year in which it was issued. The fee for delinquent renewal
applications received after January 10 of each year shall be double
the regular annual renewal fee. (f) During such time as the Commissioner's office is acting as a
primary inspection agency pursuant to Section 623 of the National
Manufactured Housing Construction and Safety Standards Act of 1974,
42 U.S.C. Section 5401, et seq., or the regulations issued
thereunder, every manufacturer who manufactures manufactured homes
in Georgia shall pay to the Commissioner a manufacturing inspection
fee for each manufactured home manufactured in Georgia, irrespective
of whether the manufactured home is offered for sale in this state.
This manufacturing fee shall be applied as follows: $15.00 for each
single-wide unit; $20.00 for each double-wide unit with two
transportable sections; and $25.00 for each triple-wide unit with
three transportable sections. For any reinspection, a $10.00
additional fee shall be charged. (g) During such time as the Commissioner's office is acting as a
primary inspection agency pursuant to Section 623 of the National
Manufactured Housing Construction and Safety Standards Act of 1974,
42 U.S.C. Section 5401, et seq., the Commissioner may adopt a
monitoring inspection fee not to exceed the amount established by
the secretary of housing and urban development. This monitoring
inspection fee shall be an amount paid by each manufactured home
manufacturer in Georgia for each manufactured home manufactured in
this state. The monitoring inspection fee shall be paid by the
manufacturer to the secretary of housing and urban development or to
the secretary's agent for distribution in accordance with the
National Manufactured Housing Construction and Safety Standards Act
of 1974, 42 U.S.C. Section 5401, et seq., and the regulations
promulgated thereunder. |
