Title 9, Chapter 9, Section 39
( 9-9-39)
(a) A written statement of the reasons for an award shall be issued
if the parties agree to the issuance thereof or the arbitrators
determine that a failure to do so could prejudice recognition or
enforcement of the award. (b) If so agreed by the parties, a party, with notice to the other
party, may request the arbitrators to give an interpretation of a
specific point or part of the award. The interpretation shall form
part of the award. (c) The arbitrators may award reasonable fees and expenses actually
incurred, including, without limitation, fees and expenses of legal
counsel to any party to the arbitration and shall allocate the costs
of the arbitration among the parties as it determines appropriate. |
